Delegate Capito moved to amend the bill by striking out the title and substituting therefor a new title, to read as follows:

A BILL to amend and reenact §57-3-3 of the Code of West Virginia, 1931, as amended, relating to spousal privilege; and expanding the exceptions to spousal privilege to exclude therefrom cases in which the offense at issue was committed against any minor, and in cases of a prosecution for an offense in which the victim is incompetent due to a mental disease, defect, or other disability.
